This Privacy Notice for BookedOut ("we," "us," or "our") describes how and why we might collect, store, use, and share your personal information when you use our services, including when you visit imbookedout.com or use the BookedOut platform. Questions? Email us at bookedoutservices@gmail.com.
1. WHAT INFORMATION DO WE COLLECT?
We collect personal information you voluntarily provide when registering or contacting us, including: names, phone numbers, email addresses, job titles, usernames, passwords, contact preferences, billing addresses, debit/credit card numbers, and contact or authentication data. Payment data is handled by Stripe — see stripe.com/privacy.
2. HOW DO WE PROCESS YOUR INFORMATION?
We process your information to facilitate account creation and authentication; deliver our services; respond to inquiries; send administrative and marketing communications; protect our services; and evaluate and improve our platform.
3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
We may share your information in connection with a business transfer (merger, acquisition, sale of assets), and when using Google Maps Platform APIs where applicable. We have not disclosed, sold, or shared any personal information to third parties for business or commercial purposes in the preceding twelve months, and will not do so in the future.
4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
We may use cookies and similar tracking technologies to maintain security, prevent crashes, fix bugs, save preferences, and assist with basic site functions. We also permit third parties to use online tracking technologies for analytics and advertising.
5. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?
Yes. We offer AI-powered features through third-party providers including Anthropic. Your input, output, and personal information may be shared with and processed by these AI service providers to enable your use of our AI products. You must not use the AI features in any way that violates those providers' terms or policies.
6. HOW LONG DO WE KEEP YOUR INFORMATION?
We retain your personal information for as long as your account is active with us, or as required by law. When no longer needed, we delete or anonymize it.
7. HOW DO WE KEEP YOUR INFORMATION SAFE?
We implement appropriate technical and organizational security measures. However, no electronic transmission or storage technology is 100% secure. You should only access the Services within a secure environment.
8. DO WE COLLECT INFORMATION FROM MINORS?
We do not knowingly collect data from or market to children under 18. By using the Services, you represent that you are at least 18. Contact us at bookedoutservices@gmail.com if you believe we have collected data from a minor.
9. WHAT ARE YOUR PRIVACY RIGHTS?
You may review, change, or terminate your account at any time. You have the right to withdraw consent and opt out of marketing communications via the unsubscribe link in our emails, replying "STOP" to SMS, or by contacting us. No mobile information will be shared with third parties for marketing purposes.
10. CONTROLS FOR DO-NOT-TRACK FEATURES
We do not currently respond to DNT browser signals as no uniform technology standard for recognizing and implementing DNT signals has been finalized. California law requires us to disclose this practice.
11. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to access, correct, or delete your personal information. 12. CLIENT DATA RESPONSIBILITY
BookedOut enables personal care professionals ("Providers") to manage their business operations, including storing personal information for their own clients ("End Clients"). BookedOut acts solely as a data processor on behalf of Providers. Providers are solely responsible for obtaining all necessary consents from their End Clients. BookedOut is not responsible for how Providers collect, use, or manage their End Clients' data. If you are an End Client, please contact your Provider directly regarding your personal information.
13. SUBSCRIPTION AND REFUND POLICY
BookedOut operates on a monthly subscription basis. All subscriptions begin with a 30-day free trial — no credit card required. After the trial, subscriptions are billed monthly in advance. All fees are non-refundable except where you are charged after canceling before the billing date, or where a technical error causes a duplicate charge. Refund requests must be submitted within 7 days to bookedoutservices@gmail.com. You may cancel at any time through account settings; cancellation takes effect at end of your current billing period. BookedOut reserves the right to modify pricing with 30 days advance notice.
14. AI-GENERATED CONTENT DISCLAIMER
BookedOut uses AI to power features including the website chatbot, automated marketing messages, and content suggestions. AI-generated content is provided for informational and convenience purposes only. BookedOut does not guarantee its accuracy, completeness, or reliability. Providers are solely responsible for reviewing and verifying AI-generated content before use. BookedOut is not liable for any damages arising from reliance on AI-generated content.
15. SERVICE AVAILABILITY AND DOWNTIME
BookedOut does not guarantee uninterrupted access to the platform. We are not liable for lost revenue, missed appointments, client losses, or other damages resulting from service downtime. Refunds will not be issued for temporary interruptions unless the outage exceeds 72 consecutive hours, in which case a prorated credit may be applied at BookedOut's sole discretion.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, BookedOut and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. BookedOut's total liability to any user for any claim shall not exceed the total amount paid by that user to BookedOut in the three months preceding the claim. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.
17. DO WE MAKE UPDATES TO THIS NOTICE?
We may update this Privacy Notice from time to time. The updated version will be indicated by an updated "Revised" date at the top. We may notify you of material changes by posting a notice or sending you a direct notification.
